Yes, for the person who asked, I do live in the south. If you live in south carolina, the code of law says you cannot connect to a computer network unless permission is expressed or implied. Leaving the connection open implies you can use it, plain and simple. So, no, I'm not a thief. However, you cannot use that connection to do anything malicious or criminal (i.e. check your e-mail and you're fine, but send spam or change the SSID and you are committing a crime.)

If your neighbor's front door is open, can you walk right into his house? Does his open door imply you can use his house?

Using any network without explicit permission is against the law, anywhere. And anyways, the supremacy clause of the Constitution allows that federal law trumps state laws. So no matter what you believe South Carolina laws say, federal laws trump them.

Bullshit. The federal computer crimes statutue trumps any state statute. Therefore connecting to any network that you do not have explicit permission to connect to is a crime.

Hey Dicksmack, try reading this.

http://www.scstatehouse.net/code/t16c016.htm

[quote]
(j) "Computer hacking" means:

(1) accessing or attempting to access all or part of a computer, computer system, or a computer network without express or implied authorization for the purpose of establishing contact only]

Do you see that? Without Express or implied Authorization. Just because it's open, doesn't grant implied authorization.

I suggest you read the entire statute. Because its VERY clear what constitutes the crime. If you're parking in a hotel lot and you're not paying for a room of that hotel, you're committing a crime, plain and simple.

Well, at least we agree. So will he continue to argue, or attempt to backpedal?

I think this deserves a trip to Lexis/Nexis for clarification of SC law. I guess you're not at work today.

http://www.lectlaw.com/def2/s105.htm (close enough for our purposes)

SUPREMACY CLAUSE - "[I]This Constitution, and the Laws of the United States which shall be made in Pursuance thereof]" U.S. Const. art. VI, Paragraph 2

Under the Supremacy Clause, everyone must follow federal law in the face of conflicting state law. It has long been established that "a state statute is void to the extent that it actually conflicts with a valid federal statute" and that a conflict will be found either where compliance with both federal and state law is impossible or where the state law stands as an obstacle to the accomplishment and execution of the full purposes and objectives of Congress. Edgar v. Mite Corp., 457 U.S. 624, 631 (1982). Similarly, we have held that "otherwise valid state laws or court orders cannot stand in the way of a federal court's remedial scheme if the action is essential to enforce the scheme." Stone v. City and County of San Francisco, 968 F.2d 850, 862 (9th Cir. 1992), cert. denied, 113 S. Ct. 1050 (1993).

Due to concerns of comity and federalism, the scope of federal injunctive relief against an agency of state government must always be narrowly tailored to enforce federal constitutional and statutory law only. Toussaint v. McCarthy, 801 F.2d 1080, 1089 (9th Cir. 1986), cert. denied, 481 U.S. 1069 (1987). This is critical because "a federal district court's exercise of discretion to enjoin state political bodies raises serious questions regarding the legitimacy of its authority." Id.

streaker69 wrote:Anyone ever sit in the parking lot of your local Orifice Depot and pick up some hpsetup? I was in another shop one time and came back out to find 12 of them. I think it's a HP machine in Adhoc mode in the store. Occasionally I'll be going through a neighborhood and find one as well. Which means like AP's, they just took it out of the box and plugged it in, nevermind trying to configure it or anything..

Just found something. It turns out that's the default ssid for HP wireless printers, among other things. (seems like they don't make good ones, see next thing.)

From http://www.elise.com/weblog/archives/000583hp_deskjet_5850_printer_review.php:

The printer works fine IF you set up an AD-HOC connection on channel 10 titled hpsetup... It took me more than FOUR HOURS to figure this out.

My sister just got one of these HP printers, if she could figure out how to get it to work on her network by herself, then anyone should be able to, without it taking 4 hours.
